MCH Cattle Records Terms of Use and Privacy Notice
1. Overview
MCH Cattle Records, the “Service,” is an in-development online cattle record-keeping and organization service for individuals, farms, and farm businesses.
A public Contact Us link is available on the sign up and login page for questions about the Service or these Terms.
Registered users can view full operator contact information in Settings > Legal & Contact inside the Service. Full operator contact information may also be provided in access, payment, invitation, or renewal communications.
By creating an account, signing in, paying for access, or using the Service, you agree to these Terms of Use and Privacy Notice.
If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old to use the Service.
2. Nature of the Service and Beta Status
The Service is a beta system under active development.
You are paying for access to an in-development online service, not purchasing a software product, copy of software, source code, database, or ownership interest in the Service.
Features, functionality, screens, reports, reminders, exports, user workflows, and system behavior may be incomplete, experimental, unstable, changed, limited, or removed at any time.
No guarantee is made that any specific feature will remain available or unchanged.
3. Paid Access, Plans, and User Limits
Access to the Service requires payment in advance.
Fees for access are based on the plan, farm, account configuration, and number of authorized user accounts selected.
Current pricing and any additional user fees will be shown at the time access is purchased or renewed.
Payment gives access only for the specific paid access period.
Unless otherwise stated at the time of purchase or renewal, a paid access period is 30 days.
There is no yearly commitment unless explicitly stated in writing.
If payment for a new paid access period is not received before the current paid access period ends, access may end when the current paid access period ends.
If a payment is reversed, cancelled, disputed, or not actually received, access may be suspended or terminated.
4. Pricing Changes
Pricing for the Service may change from time to time.
Where reasonably possible, pricing changes will be announced at least 60 days before taking effect.
Any new pricing applies only to future paid access periods.
By paying for a future paid access period after a pricing change takes effect, you agree to the updated pricing.
5. Payment Methods
Accepted payment methods and payment instructions will be provided at the time of purchase or renewal.
Access begins or continues only after payment is received and applied to the account.
6. Cancellation and No Refunds
You may cancel access at any time by:
sending written notice through the Contact Us method made available by the Service operator, or
simply not paying for another future paid access period.
Cancellation stops future paid access periods only.
Unless access is ended earlier under these Terms, access continues until the end of the current paid access period and then ends.
All fees are non-refundable except where required by applicable law.
Once a paid access period has started, the fee for that period is earned and non-refundable. No full or partial refunds, prorated refunds, credits, or reimbursements will be provided for:
unused time,
early cancellation,
feature changes,
feature removal,
interruptions,
data loss,
missed reminders or notifications, or
discontinuation of the Service.
7. Accounts and Security
You agree to provide accurate and current account information.
You are responsible for keeping login credentials confidential.
You are responsible for activity that occurs under your account until unauthorized access is reported and the Service operator has a reasonable opportunity to respond.
If you believe your account or password has been compromised or used without authorization, you must notify the Service operator as soon as possible using the available contact method.
8. User Accounts and Account Sharing
Access to the Service may be limited based on the number of user accounts included in a plan or paid access arrangement.
Each user account is intended for use by a single individual.
Login credentials must not be shared between multiple individuals.
Farms, businesses, and organizations using the Service are responsible for ensuring that each individual user has their own authorized account.
Additional user accounts may require additional fees depending on the current pricing structure.
Accounts that appear to bypass or circumvent user limits may be suspended or terminated.
9. User Responsibility for Records
Users are responsible for the accuracy, completeness, and safekeeping of all information entered into the Service, including animal records, notes, reminders, and other data.
The Service is intended to assist with record keeping but does not replace a user’s responsibility to maintain accurate and reliable records for their own operations.
Users should regularly review and verify their records and maintain independent copies of important records outside of the Service.
The Service operator is not responsible for errors in records, incorrect data entered by users, accidental deletion of records, overwritten data, or changes made by users or other authorized users of the account.
10. User Data, Privacy, and Third-Party Tools
The Service may collect, store, and process information including:
your name,
your email address,
your farm name,
notes,
reminders,
animal records, and
other information you choose to submit through the Service.
The Service may also collect limited account, payment, technical, and usage information reasonably needed to operate, maintain, support, secure, improve, test, and deliver the Service.
User data and account information may be stored using cloud-based systems so the Service can be accessed remotely.
Access to your data is intended only for:
you, for your own account and data,
the Service operator,
authorized persons helping with development, operation, support, troubleshooting, maintenance, security, backup, testing, design, or improvement of the Service, and
third-party tools, platforms, contractors, consultants, and service providers reasonably used in connection with the Service.
These third-party tools, platforms, contractors, consultants, and service providers may include, without limitation:
hosting, storage, backup, communications, analytics, payment administration, maintenance, and security providers,
graphical interface design, prototyping, wireframing, or design software,
AI-assisted systems used for development, design, support, testing, drafting, troubleshooting, or improvement of the Service,
software development environments, code repositories, build tools, testing tools, and deployment tools,
Apple development tools, including Apple platform development tools such as Xcode, and related Apple or platform partner services, and
other third-party systems or providers reasonably used to build, operate, support, maintain, secure, test, improve, or deliver the Service.
Information may be used to:
create and manage your account,
provide remote access to the Service,
record and confirm payments,
operate, maintain, troubleshoot, test, and secure the Service,
support, design, and continue development of the Service,
communicate with you about your account, payments, updates, support, or Service changes, and
comply with legal obligations or protect rights, safety, security, property, or operation of the Service.
Information may be disclosed where required by law or where reasonably necessary to protect rights, safety, security, property, or the operation of the Service.
On written request, and after identity verification where appropriate, reasonable efforts will be made to provide access to your personal information and correct inaccuracies.
If you want your account data and personal information removed from active systems after cancellation, you must send a written deletion request through the available contact method. After receiving a verified request, reasonable efforts will be made to remove applicable data from active systems within a reasonable time.
Cancellation by itself does not automatically require deletion of your data. If you cancel but do not request deletion in writing, your data may be kept until you request deletion or until it is deleted in the ordinary course of operating the Service.
Even after cancellation or a deletion request, information may still be retained in backups, logs, archives, payment records, security records, or other retained records where reasonably necessary for:
legal compliance,
dispute resolution,
fraud prevention,
enforcement of these Terms,
security,
troubleshooting, or
ordinary technical deletion cycles.
Deleted data may not be recoverable.
Reasonable administrative, technical, and organizational safeguards are used, but no internet-based or cloud-based system can be guaranteed completely secure.
11. Independent Records and Data Loss
The Service must not be relied on as your only record-keeping system.
You are responsible for maintaining independent records and independent copies of important records outside of the Service.
The Service is intended only as a supplemental organizational tool.
Data stored in the Service may be lost, corrupted, deleted, or become inaccessible due to technical issues, system changes, or service interruptions.
The Service operator is not responsible for loss of data stored in the Service.
12. Reminders, Notifications, Reports, and Exports
Reminders, notifications, reports, exports, and similar tools are convenience features only.
They may be delayed, incomplete, inaccurate, duplicated, unavailable, altered in error, or removed.
No guarantee is made that reminders or notifications will be delivered on time or at all, or that reports and exports will be accurate, complete, or available in any particular format.
Do not rely on the Service for emergencies, urgent animal care decisions, or other time-sensitive matters.
13. Livestock and Operational Disclaimer
The Service is a record-keeping and organizational tool only.
The Service does not provide veterinary advice, breeding advice, livestock management advice, legal advice, tax advice, accounting advice, financial advice, or business advice.
All operational decisions remain solely your responsibility.
14. Acceptable Use
You must not:
use the Service for any unlawful, fraudulent, abusive, or unauthorized purpose,
access, attempt to access, or use data, systems, or accounts that are not yours or that you are not authorized to use,
interfere with or disrupt the Service or any systems used to operate it,
bypass, disable, or circumvent security protections or access controls,
upload or transmit malware, malicious code, or harmful material,
scrape, mirror, reverse engineer, copy, or reproduce the Service except to the extent a non-waivable law expressly permits it,
use the Service in a way that infringes another person’s rights, or
misrepresent your identity or authority.
15. Service Availability, Changes, and Discontinuation
Availability of the Service may change at any time.
Access may be interrupted, limited, degraded, or unavailable due to maintenance, updates, testing, development work, third-party service failures, hosting issues, internet or connectivity problems, security issues, legal or regulatory issues, or events beyond reasonable control.
The Service may be modified, suspended, or permanently discontinued at any time.
If reasonably possible, notice of major suspension or discontinuation may be provided and users may be given an opportunity to export data before shutdown, but no minimum notice period, continuing availability, or ongoing access to data is guaranteed.
16. Intellectual Property and Limited Access Right
Except for your own User Data, the Service and all related software, designs, text, graphics, interfaces, branding, names, logos, and other content are owned by the Service operator or its licensors and are protected by applicable intellectual property laws.
Subject to these Terms and payment of all applicable fees, you receive a limited, non-exclusive, non-transferable, revocable right to access and use the Service during an active paid access period for your own internal personal or business record-keeping purposes.
You do not acquire any ownership rights in the Service.
Any ideas, feedback, suggestions, or feature requests you submit may be used without restriction, attribution, or compensation.
17. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
No warranty, representation, or guarantee is made regarding:
uninterrupted availability,
error-free operation,
continuous availability,
security from data loss, corruption, or unauthorized access,
accuracy, completeness, or reliability of records, reports, exports, reminders, notifications, or results, or
suitability for your needs or intended use.
Use of the Service is entirely at your own risk.
18. Limit on Liability
Except where the law does not allow it, the Service operator’s total liability to you for any claim related to MCH Cattle Records is limited to the amount you paid for your current paid access period.
19. Changes to These Terms
These Terms may be updated or modified at any time without notice.
The current version applies each time you sign in to or use the Service.
By signing in and continuing to use the Service, you agree that the current version of the Terms applies.
Where a specific legal requirement requires notice or renewed consent for a particular change, that requirement will govern.
20. Governing Law
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta.
Any dispute, claim, or proceeding arising out of or related to the Service or these Terms will be brought before the courts of Alberta, unless applicable law gives you a non-waivable right to bring the claim elsewhere.
21. General Terms
Nothing in these Terms is intended to waive any rights that cannot legally be waived.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
A failure to enforce any provision is not a waiver of that provision or any other provision.
These Terms form the entire agreement regarding the use of the Service and replace prior discussions or understandings about the Service to the extent permitted by law.
The Service operator may assign or transfer these Terms and any related rights or obligations, including to a future corporation, purchaser, successor, or project transferee. You may not assign or transfer your rights or obligations without prior written consent.
Any provisions that by their nature should survive suspension, termination, expiration, or discontinuation will survive, including those relating to payment, data retention, intellectual property, disclaimers, limitation of liability, governing law, and general terms.
